Ok, so last Christmas my Brother-asshole-law gave me a Trance 3. Today I was talking to his wife, my sister and told her I was selling it and buying a new bike. She told him and he went crazy. He said if he would have known that I was going to sell it he would have sold it himself. Now she wants me to give it back because I've been an asshole? What the hell, is that even right? If it is a gift do I not have the right to do with it what I please? I love my sister like most brothers do and I've been grateful that he has let my borrow his camera equipment and that he gave me $1500 bike, but really, can I do what I please with it?

If you were to be found 'not guilty', it would be on a technicality. I'm sure you're probably a nice guy, but if someone gives you a bike(or anything) as a gift- presumably to use- you should use it for AT LEAST a year or so before considering alternatives. To do otherwise appears somewhat less than classy.

He and she are both being highly unreasonable. If anything he could have just told you that he does not want you to sell it and leave it at that. No reason to get all fired up about it.

Dunno kid, sounds like your're kinda spoiled. Let's see... You're only 15, your brother-in-law let you borrow his camera equipment then GAVE you a $1500 bike, now you want to sell the biike less than a year later and can't see how ungrateful that makes you look? Wow. Wait until you have to work for a living, pay bills, etc. Then, maybe, just maybe, you'll understand how far your brother-in-law went to try to be cool towards you. Cameras and the equipment aren't cheap nor is the bike he gave you. So, yes, you have been an @sshole. You should just say "thank you for the bike", "sorry for being such a little d!ck" , and get a part time job to earn the money for whatever you wanted to buy with the cash you would have gotten after selling your Christmas present. JMHO.

The issue with a gift like this is that an appropriate gift for Xmas typically costs $100, unless your bro-in-law is Bill Gates. That kind of gift you could probably do what you want with, without any flak.
However, when someone gives you a nice bike, the idea was that you obviously would ride it.
There are a lot of examples like this: my bud had to sell his ti Colnago and keep some POS alu frame because his family bought it for him; I gave my cousin a $500 hardtail for free because I wanted her to ride more.
Basically, if you are not going to ride a very nice bike, then you give it back.

Alright, I'm looking for a job now..thank you, I'm grateful for everything I own. If you ask any of my friends and if you actually knew me you would know I'm not spoiled, nor am I wealthy. For god sakes my mom just started selling Avon to keep a roof over our heads. Lets just say I'm in the right place at the right time? I've rode the hell out of my bike, it needs alot of work, thats why I even thought of buying a whole new bike. I need new brakes, new fork, new wheelset, and new shifters. All I wanted to do was sell it for a decent price, buy a .243 and put new all new parts on it. I live in a freakin 2 bedroom duplex, Mud n sweat you know how big these duplexes are, your friend lived in them. I work hard for what I have, and I don't have much. I come along what I have by accident, it was his idea to give me the bike. I geuss your right on one part, I should have kept it longer before saying anything, but when you a give a gift to someone, you don't ask for it back, that's what I've learned with my 15 years and 350 days on earth.

I have to agree.
I just gave my brother in law a $1500 Ti hard tail to ride since when he got here he had nothing. If he were to flip around and try to sell it, I think his sister would kick his ass long and hard well before I got to him.
So yes, you're being an ass. Save up, buy your own rig, ride what you have until it dies. That shows respect and appreciation.

Now that's even more of an asshat thing to say.
Honestly, I would have taken the bike back the minute I heard you were going to sell it...
Like everyone else has said, your brother in law is not Bill Gates. That's a hell of a nice gift, even if it was intended to get him some BJ points with your sister under the Christmas Tree in her naughty schoolgirl lingerie while barking like a Dolphin...
Do the right thing here, if you don't I can promise you that in years to come this will cause heat between the two of you. If he's grumpy enough to take the bike back, he's grumpy enough to carry a grudge. You won't like it in years coming if he always has a problem with you.
Oh yea, I wouldn't count on getting another gift like that again from him...

Yeah, Tattooo can you ever for once in your life make a post without some pervented statement, def. when it's about someone sister? I really would appreciate if you didn't say things like that, not only does it make you seem like a total perv, but also like you will never once in your life have a serious relationship. you're the one the who brought your sister in with that little sh!t comment about:

So obey the first rule of the Monkey, if you don't want something made disgusting, then don't discuss it.
maybe you should take some of that indignation and consider how your brother in law feels.

if the bike REALLY needs all those parts you mentioned, and you can't ride the bike without them, then tell him that, and tell him it makes more sense to sell it, if he has any logic he'd understand.
if the bike is in fair shape, and you can ride it for another year - do so, and apologize, say you did not mean no harm, and you really appreciate the bike. In that same year, get a job, save up some money, then sell the bike once it turns 2 years, and get a new one.
You are young, you have PLENTY of riding time ahead of you, plenty of other bikes ahead of you. Another year riding on the same bike is not gona hurt. * I rode the same bike for 4 seasons during college

Alright alright, everyone calm down!
First off, Bryan is not a spoiled kid. Probably even a lot less spiled than most on this board were at his age. He's actually a great kid with a good head on his shoulders in general. He obviously asked this board for their opinion thinking he could get some honest answers. While honest answers were given, they could have been a little less berating. I'm sure Bryan would take it to heart a bit more.
Secondly, Tattoo was definitely just kidding. Sure he has a more perverted sense of homur, but it in no way should be taken seriously. It's funny how the older you get, the funnier the more taboo stuff becomes. Over time it just takes a lot more edgy humor to get a good laugh. You should here the **** talking my co-workers and I dish out to each other, it is WAAAAAAY brutal but we all take it lightly and laugh along even when the joke is on us.

Seriously, its not like she really makes dolphin squeels, right...
Or does she? If so, I have to remap my whole advice...
Assuming she does, go like this:
- Make a big stink with your brother in law, get him to punch you first. Your sister will leave him.
- After she revisits the good fun of college, she'll get back into wanting a husband.
- I'll take her as my second wife (its not bigamy, its big of me) and I'll be your new brother-in-law. Yes, she'll be making like a dolphin from time to time, but you can ride my Nomad as a fair trade.
See, things could be worse.

OMG! You are so spoiled!
The guy should be phuking happy. You are selling a well used bike to get another one. It is YOUR bike. You can do whatever you want with it. It is not ungrateful to sell the bike that you were given, and buy another one. It sounds like you got great use out of the bike. It is not like you are selling the gift to buy an ounce of weed or anything.
Thank your brother in law again for the bike. It was a great present. If he can't see your reasoning then simply explain to him that you have worn the bike down, and you would like to sell the Trance for something newer. He doesn't have to understand.
The issues that people are bringing up here are ridiculous. Do what you want with the bike. You will have NOTHING to feel bad about.

I gotta say, I don't think vaniliavillian81 is wrong for wanting to sell or trade his current ride for a bike that better suits his needs. It was a gift and in the true meaning of gift giving, it should not come with strings attached, no matter the cost. I think it Bro-in-law is probably an ass.
Vanillin, perhaps if you carefully explained the rational behind wanting to sell the bike? I think your reasoning sounds good to me. Maybe you can explain it calmly in a way your bro-in-law and sis can understand? You know, something like: It doesn't suit my current riding style, will cost more to repair and upgrade than purchase of a new bike.
As an aside... I do worry that if it needs all that you say it does that you aren't going to get much for it.

I think this is a gift with strings attached. No one gives a $1000+ gift without one, which usually ride it and don't sell it.
Put it this way, has anyone here given a bike worth over $300 to someone?

Put it this way, has anyone here given a bike worth over $300 to someone?
I have two times, but both times it was to my wife so I guess maybe that really doesn't count. But if she wanted to sell one of them because she wasn't riding it and wanted something else or wanted a different kind of bike I would be totally cool with that. The reality is I would want her to be happy with the gift and if not exchange it for something that would make her happy. The trite expression that comes to mind is "Tis is better to give than to recieve."
The 'no strings attached' thing is my own personal belief. I just think that if you can't give a gift without strings then it's not really a gift, it's a loan and you should explicitly indicate that that is the case so crap like this doesn't happen. I believe the trite and politically incorrect expression for this case is "indian giver".

O.K. I'm going to try to make this as clear as I can. My reasons for selling the bike vary, a couple months ago, me and Foky were hitting some new jumps we just built up in a fairly wooded area..maybe to woody. I hit the jump, cleared the tranny totally and was going to fast to make the turn and ate total sh** into a tree. I was knocked out, and don't remember anything else before the hospital when the guy was telling me not to move my neck. When I did this, my fork became a piece of shi**, so did my body. Not only did my fork die in that wreck, but so did my front brake, which now leaks fluid all the time. My wheelset has also become unworkable. I not only used the bike for XC bt also hit the UVA drop...which is about 7-8 feet im geussing? Yes, I look back on it now and say, I should have never hit those drops on on this bike. My interest for XC has dropped alot now, saying my bike can't even work properly. I'm more interested in dirtjumping, downhilling, and street riding. This is because the maintance envolved is much less. No rear shock, no deralieur, no gears. I also will be buying a car soon.
My idea was to sell the trance, then buy a .243...which the frame is only 200 obo. I was hoping after I built the bike I would have some money left over to go into my bank account for the car. It just seems less of a hassle to buy a whole new bike instead of a new fork, new brakes, new wheelset.

Question: How do you plan to sell this bike if you've abused the poo out of it? Were you just going to try to sell the frame and what ever parts still work?
Note to self: Do not buy any bikes from Vakillin81...

Let's cut to the chase:
Ethically, it was a gift, and you should do whatever you want with it.
How will effect your family? I am sure people will just say you got a $2000 bike (funny how bikes go up in value when they are gifts), and you abused it and then had to sell it.
Do you care what your family thinks about this matter? You don't have to...

family dynamics, "no string attached" gifts, etc etc are really all seperate and distinct in each household and the individuals involved. what you technically can do, what you technically might do, isnt always synonymous with what you should do. and what you should do is a very grey area indeed. should you technically be able to do what you want to with a gift? yeah, technically you should but any husband/father knows that isnt always the case (and you guys who are husband and fathers know what i mean). bottom line is there is no right answer to you questions, only opinions on what responders would do/feel if they were in that situation, which as you can see varies from 1 extreme to the other.
it would also be interesting to know the age, and status (married, not married, kids, no kids, etc) of each responder to see if there are any commonalities in age and status as to the responses but thats another whole can of worms better left unopened. lol

That, is still left unopen, I have NO clue how I'm going to sell it. I'm looking at it now, just sitting in pieces in my room, I'm really thinking about just keeping the damn thing. Family is more important to me then selling some bike that's worthless when it comes to still talking to your sister or brother-in-law. If I break my relationship with either of them my career as a photographer is broken. This means, no more passes into race tracks, no information on how to use so and so in photoshop, and no mentor. I'm really thinking about keeping the bike, getting a job, buying a car, then saving money for a new bike. I can legally get a job in 2 days, I plan on going everywhere to find one. So if you know anyone in management in C-ville, you should let me know.

Good plan.
My friend with Ti Colnago wanted to dump his cheapo alu bike badly, but he knew his family would not understand that the Colnago was mint. So he kept his gift bike, sold the sweet one, and maintained his relationships...

I have the final answer.
I'm keeping the bike, my photography is more important to me than riding right now. I plan on saving for a new 20D, and a new lense(maybe the 35mm Wide angle 2.0-Or the 28-200?). I'm really am interested in the XTi, so I'm not sure yet. Or a 5D, but I have heard by many of people it is more of a "studio" camera. I'm going to have to get out their and field test it. I don't know about you other photographers, but I don't like my camera the way the rebel feels, I like the weight. Also, since the XTi is coming out the 20D price may drop.

I am an Nikon whore personally. We have a couple D90's, and a grip of lenses. I'd suggest when buying a lens you look at how "fast" it is. Both in how quick it can focus and the lowest f-stop on it. Nikon makes a great 80-200 with a constant 2.8f which we have.
Also, save up to invest in your flashes and batteries, and memory sticks.

Yes yes I know this lol. I use all L lenses right now, so what can I say my brother-in-law has a nice selection.Nikon has the best selection of lenses. But none of the bodys will ever compare to Canons, nor will the autofocus and fps. I have a Nikon film camera I'm using right now, It's nice, but the body feels cheap, dull, too light also. I'm use to having two shutter buttons because the Canon has the battery grip on it. Everytime I hold a 1D Marl II I want to crap myself.

I think this is quite possibly the first time in my life that I have ever heard one man tell another man he would only give him a free $2,000 Ti MTB if he slept with his sister first.
Am I sleeping with your sister?
Sure, for 20 bucks, go for it. She's a bitch anyway.
